Dear Chief of Portland Police Marshman:
I'm informing you of misdeeds of Portland Police Bureau personnel, as I did in our personal conversation a few weeks ago, now with the assistance of the materials I've attached. I'm providing you, and it follows, Portland Police Bureau Internal Affairs, the means to rectify an ongoing assault on my civil rights effected by the Portland Police Bureau; misdeeds done with the continuing support of the Multnomah County District Attorney. I believe the acts against me violate the settlement agreement with the USDO, and have copied this to them (community.portland@usdoj.gov)
November 25, 2015, after I sought emergency medical transportation for my central pain syndrome, I was arrested and subject to excessive force, then was booked under a fake birthdate and physical description invented by the Portland Police. Since then, my goods were unlawfully destroyed as I was in custody on a bogus felony charge. My property receipt, a notice essential to legalize any destruction of my personal goods, wasn't given to me until February 9, 2016, after my goods were destroyed on February 4, 2016. On November 25, 2015, Portland Portland Police Bureau personnel arrested me for criminal trespass and seized my goods when City Hall staff used a bogus trespass exclusion policy I said I wouldn't abide by, and exclusion which was itself a product of false characterization of my actions November 24, 2015. That trespass exclusion policy has since been found unconstitutional by U.S. District Court Judge Simon. Following my arrest, I was booked into jail with the birthdate of August 13, 1962.
That birthdate, if undiscovered, would have prevented my telephone access in custody, since the telephone access code is a product of the inmate's birthdate. It came to being as a product of Portland Police Officer Stegemeyer then the Multnomah County District Attorney creating ; "aka Barry Joe Stully DOB 08-13-1962" in December 2009.
Back then, I was arrested for trespass at Bullivant Houser Bailey where I sought payment for the $4,775 damages Bullivant's client PCRI owed me, but wouldn't pay, for the illegal destruction of my goods from Kafoury Court, 4066 NE Grand Avenue Apartment 5 in October 2006. As you know, PCRI has been keeping that affordable housing complex vacant for years, including during our declared housing state of emergency, and the City is still partnering with PCRI.
I've long claimed Multnomah County Circuit Court Judge Edward Jones acted criminally when he allowed PCRI to escape civil and contempt of court liability for PCRI's illegal destruction of over $20,000 of my goods in 2006 as I was appealing PCRI's eviction filed and prosecuted without court jurisdiction, since it was filed under ORS 90.427(2) against the express statutory prohibition of ORS 105.120. (Mayor Communication attached) The court lacked jurisdiction to hear PCRI's eviction case since what can't be filed , can't be heard. It's not lost on me my very own Oregon Supreme Court case, Stull v. Hoke, defines the act of filing a case in Oregon, or that my oppressors are acting criminally with impunity.
November 25, 2015, staff on duty in the jail first realized I didn't fit the given description of 6'2"" and 260 pounds (because I'm 6' and 210 pounds as it states on my Oregon ID). Then they discovered I was booked under a false birthdate.
I was booked under a false birthdate and physical description which were both created and provided by the Portland Police. The criminalist on duty in Multnomah County Detention Center, a Portland Police Bureau employee, took a new set of fingerprints and established my correct date of birth as September 24, 1958. I understood the date of birth presented to Multnomah County Sheriff Office personnel staffing the Multnomah County Detention Center was product of the prior Police and DA fiction in 2009.
My illegal incarceration on a bogus felony was intended to force me into accepting a plea bargain, instead of challenging the pending criminal charges against me. Yesterday, September 1, 2016, the DA filed a motion which intends to again delay my trial, this time in an effort to consolidate my charges with a matter I had nothing to do with, except that individual was documenting my arrest. Yesterday's motion noted I was charged with a felony which has since been dismissed.
That felony charge was a product of fraud before the Grand Jury. As I mentioned in our face to face conversation, both Portland Police Officer Engstrom and Portland Police Sergeant Price completed November 25, 2015 reports stating there were no injuries, then Officer Engstrom and James Woods appeared before a Grand Jury to produce a felony indictment for my intentionally injuring Officer Engstrom. Officer Engstrom reported to the United States Department of Justice, via the mandatory use of force report there were no injuries (see attached report page 2/3), as was reported in Sergeant Price's After Incident report (see attached report page 1, where I'm also falsely characterized as a "transient"). The asserted "known history of mental illness” conflicts with mental health professionals not able to diagnose a mental illness, aside from a few observations I’m delusional because I think the police are acting against my interests, which I think I’ve proven here they are. Central pain condition is a neurological condition where I’ve experienced a heart rate of 175 beats per minute requiring forty five minutes of critical care to prevent circulatory failure, and I don’t want that to happen again because Portland Police have a practice of using excessive force against persons perceived to be mentally ill.
I want the Portland Police Bureau to remove the inappropriate physical description and birthdates from my records within the Bureau's information system, and I want those who lied about me to keep me in custody long enough for my personal goods to be destroyed investigated and held responsible for their obvious misdeeds against my civil rights.
