Dear Portland Independent Police Review Director Constantin Severe:

can you please explain why IPR has decided to abruptly cancel my rights to an appeal of your exoneration of 6-29-16 excessive force and misconduct?

Since the violence at city hall has escalated, my sense of safety overall about portland is so diminished, that i wonder, have you canceled my case out of concerns for my safety?

It appears something has been misplaced. In your most recent snail mail, you reference a letter that was never sent to me.

Also, Investigator Jon Rhodes was never forthcoming with the 911 transcript.

My writings and letters on the subject have been exhaustive.

My appeal request, though concise, should not be dismissed.

Mr. Severe, i did not understand that you wanted me to write more reports, commentary, etc OR ELSE you would close the case.

If that is so, why not say so?

I asked you many questions which went unanswered. SO i awaited your response which was not forthcoming.

I was still thinking of what to say and would like to know if i need to write it according to the Officer A &B anonymisation service, and my requests for technology advise about how to present cases, were not answered. i had questions about how to hook up a laptop to reference the anti-retaliation clause of the settlement agreement.

i found the delay excessive, and considered calling your office.

In your letter you said you would send a date for the hearing.

So, when you asked for an additional write-up, i did not understand the parameters of your writing assignment, and what its relevancy would be. Will it be photocopied for all attendees to the hearing?  How can i maximize my self-interest for medical privacy, whilst accurately divulging enough information that some discovery is made? 

Is it a summary for the CRC members? Or for IPR internal memos?

I asked whether the offending officers would be present, and got no response.

How does this cancellation comport with my rights under ADA, if i tell you i need more time, and more explanation of what you desire?

It appears that you guys have excessively delayed, denied info, and drug your feet to exhaust my patience, and now suddenly have found an excuse to get out of having a hearing.

I have been gathering my files.

I promise, i'll be nice.

i have been ready for a hearing from day one. It is not very USER-Friendly to manipulate your arcane "byzantine" city code, to quash cases that may be inconvenient.

I consider my offer to present an appeal, Community Service.

could you explain, in writing, what you would like me to write, and what means to introduce evidence in hearing. Whether or not to protect the officers identity for the greater public. Why are my exhaustive letters and bloggings on the topic, insufficient.  May i provide video-blog format?

May i attend via phone call?

Clearly the wrist-crushing and shoulder-ripping has affected my health, so your sudden impatience after such delays, seems erratic.

You know i have some travel to do to come into town, and i have asked for all accessibility accommodations possible.

In particular i would like an American Sign Language interpreter for Phil Wolfe to attend, and i would like to have dates i can run by him, so he might check his schedule for availability.

I assume there is an evidentiary procedure.

I explained on my appeal form that there was a rapport problem with Rhodes.

He has a hostile, condescending, and ridiculous tone. It destroyed the process of investigation.

I would love to tell you all about it.

It shattered my faith in the process.

How may i introduce witnesses to the hearing, as there are witnesses i would like to call.

With whom may i take this up? If not a hearing.

Greg kafoury told me not to mess with IPR when i called him for advise on Benjamen Pickering's police brutality in summer 2013.

I can see why, with such crafty shenanigans.

I'd like to stay positive.

Please email me, what means there is of obtaining the appeal hearing.

Your letter did not explain, that you would close the appeal without warning. 

You told me you'd set a date. So, when is it?

I understand you are busy, and as Mr. Rhodes explained to me that this is a "waste of his time" and Engstrom is unimpeachable.

It may indeed be a waste of all our time to even think there might be consequences for blatant retaliation to whistleblowers.

But let's be positive, and enjoy the process.

Please send me a scan of my appeal form, and indicate why you have suddenly denied my right to appeal.

i would also like citation of the city code, and an explanation of how your termination of my appeal writes comports with the ADA.

This letter acknowledges receipt of your Appeal Request on the above case. In addition, please provide in writing specific information regarding your dissatisfaction with the investigation and the Police Bureau’s findings on the allegations. This will help the Citizen Review Committee have a better understanding of your written comments about the investigation.

We are currently looking for possible dates to schedule the hearing. Once we have a date selected, we will send you a formal notice with more information about the hearing.  Please also let me know if you have any additional questions about the appeal hearing process.

Thank you for the invitation to Appeal my Internal Affairs claim for the Portland Police event 6/29/16 when officers briskly chased me outside of city hall, for a reason unbeknownst to myself.

The Injuries i sustained were true in my subjective experience of pain and trauma. I am Sure Portlan Police's subjective experience of infallibility also incurrs a feeling on non-injury. Except certain details, like Allison Walz wincing in discomfort as i explain my wrist injury in MCDC dungeon, nodding as i asked if i would get medical care.

Please note that as a person who takes great interest in the law, my "enjoyment" of the whole bizarre experience does not negate the PAIN and Discomfort i felt at injury. The Logical Fallacy that the brain cannot experience Intellectual Curiosity and Pain at the same time, is a bit naive.

Pleasantries On-Camera do not negate Injuries Off-camera.

i just mailed in my appeal of Internal Affairs findings re: my arrest as i was leaving city hall 6-29-16 after speaking about Americans with Disabilities act rights as it pertains to blind people, disabled people, and police brutality victims who are also disabled.

I want you to know that i take the concerns enumerated very seriously and have mailed my appeal form.

I would highly suggest Officers in Question to be present, as well as Jon Rhodes.

I have never emailed Engstrom or Walz, and wonder if there is any additional way of encouraging them to attend the appeal, or if it is purely a matter of their own preference.

It is my desire to maintain a high degree of decorum and respect, and not in any way demean any parties for any misunderstandings about the law, my rights, or their responsibilities.

I believe it would be refreshing to have a reunion and also look at the positives.

it might give them closure, as it might me.

I appreciate the staff resources it takes to hold these meetings and have concerns from an audio-visual angle that the public is only permitted to film the BACKS of HEADS of the Injured party, while CRC board members get a full face shot , IPR reps, and police get side angles.

I am concerned this inhibits audio quality, and gives preferential treatment Staff in disrespect to Citizens.

I would like to know, that if and when the appeal is scheduled, and if we are so lucky as to have citizen film-makers present, can the cordoned off area permit face angles of the Complainant, in this case me.

I do not want my word to be lost to ineffectual camera angles.

It is a pity the city refuses to make video archives of CRC, and by failing to employ full tech, leaves the burden on unpaid volunteers.

(Microphones are often very insufficient at city hearings, and it is frequently difficult to hear the police representatives and sometimes IPR.)

I very much look forward to discussing my concerns regarding Noncompliance with the Anti-retaliation clause of the settlement agreement.

Also Jon Rhodes, what are the ways i can gain all case material prior to this hearing?

Where is the 911 call?

I would like an audio file as well as transcript. I know you have a transcript. Will you share?

Also, i would like to know if there are documents i would like to display in a digital manner, will there be an easy plug in. I believe i saw Matt Klug doing a great job with his laptop.

If so is an apple computer fine too?

That's all i can think of now, and i wish we had this face-to-face in July, it has been such a long wait, but perhaps time heals!
