Press Release and notice of Federal Action by Joe Walsh 11/28/2017
On November 28, 2017 Joe Walsh, founding member of Individuals For Justice filed a First Amendment violation by the City of Portland, Mayor Ted Wheeler, and the Portland Police Bureau. The events and the continued reactions of the PPB have caused me to file this civil suit asking for a Permanent Injunction and punitive damages because what I contend was a gross violation of my right to protest in a city... park, Chapman Square on June 4th, 2017. Individuals For Justice is a non-violent group who has never committed a violent act against anyone including the city of Portland. We fight with our pens, sometimes with our mouths at City Council meetings but we never use our body for violence. The City of Portland, on June 4th, 2017 decided to attack me and other disabled people with bombs and chemical warfare without sufficient notice so that all in the parks were not notified of this dangerous action. There were also children in the parks during the attacks of Chapman and Lowsdale Square/Park. I have asked the Federal Courts to do three things:

1. Take jurisdiction of the case, under the 1st Amendment.
2. Wave all federal fees
3. Allow me to present this case “Pro Se.â€
I believe the case itself should win the day and does not need a fancy lawyer at this point. I will present oral arguments and we shall see where we go from there. There were over a thousand innocent people in the parks that day, but under the Pro Se concept I can only file for myself. My hope is that the court will accept jurisdiction and other cases or a class action suit will happen. The city should be ashamed of what the police did on June 4, 2017!
What we do now is wait for the courts to decide if they will take jurisdiction. I will let you know! I believe we must travel every path concerning the chemical attacks on citizens exercising their Constitutional Rights. This cannot stand!
PS After going to the Federal Courthouse, I traveled over to the den of sulfur and had a mocha! Did I ever tell ya how much I love mochas?
